Failure to diagnose– It is a doctor’s responsibility to follow a patient’s care and this includes making sure a patient is scheduled for tests or labs to properly diagnose a condition in a reasonable amount of time. Physicians can be held liable for the failure to diagnose cancer, heart attack, or any other condition that can cause harm if left untreated. The patient can suffer long term consequences or even death from a preventable medical error.
Brain injuries– The have three categories Mild, Moderate, and Severe.
Mild- involves the loss of consciousness with a maximum of 30 mins, mental status changes due to a concussion, headaches, dizziness, and confusion as a result, MRI’s and CT scans may not show any damages.
Moderate- can include any minor symptoms that continuously get worse in time. Loss of consciousness that ranges from 15 minutes to up to 5 hours. Brain and tissue damage will be evident in brain scans
Severe- Swelling of the head or brain, loss of consciousness lasting 5 hours or more, head injuries that result in permanent neurobiological damage or the loss of cognitive abilities and sensory function.
Brain injuries that are caused due to medical negligence can include Anesthesia malpractice, Hypoxic (lack of oxygen) injury, neglecting to treat metabolic imbalances, failure to properly diagnose and treat a severe concussion, drug interactions, and a deep vein thrombosis that was not treated.
Spinal cord injuries– When a patient suffers a spinal cord injury it is not only a major liability but this life long injury that must involve not only the immediate financial cost but needs to include a comprehensive life care plan that will allow for future care. These type of injuries can come from the negligence of misdiagnosis of an infection, delayed diagnosis of a tumor or misdiagnosis of a spinal cord impingement resulting in permeant nerve injury, and improper diagnosis and treatment of a ruptured or herniated disc.

Inadequate monitoring of the oxygen-enriched environment leading to operating room fires, leaving surgical instruments or other further foreign materials in a patient’s body is negligence.
Wrong prescription or negligent administration of medication by injection or IV-To over-administer of a prescription medication, chemotherapy or radiotherapy that causes the patient further morbidity or death is negligence. The failure to properly administer injections can cause several reactions that can cause injury.
